Anti-Abortion's State by State Theory is on its Head
Over past decades, I've read notions like this on anti-abortion web sites and magazines, "The Roe v Wade decision is a millstone around our necks. With a Federal Law giving legal approval to abortion we are running into a brick wall trying to eliminate this murder. If only we could overturn Roe and put the issue back into the states, we could win against abortion state by state. We will do this until it is outlawed in every state and thus in the entire United States."
Now anti-abortion is learning it was wrong all along. It is abortion rights that will win state by state across the U.S. The entire state by state theory is being turned on its head. Of the Supreme Court Justices who are crazy against abortion, I wonder how many now realize they've been had. Could it be Judge John Roberts said to them privately, "I'm with you here. Let's overturn Roe and then we will have washed our hands of abortion. State by state it will be tossed out." Roberts would have done this with a wink-wink to himself, knowing the opposite would happen.
In all of this turmoil, I can't forget a remark the late Judge Ginsburg made years ago. She said, I'm paraphrasing, abortion will be more widely available if it is decided state-by-state. I don't know if this was a carefully considered view or an on-the-fly remark, but it is worth considering. Gay marriage was approved state by state.
Anyone who has paid attention to state-wide measures where people vote on abortion rights would have recognized the odds of abortion rights are better than anti-abortion. I think abortion has been on the ballot four times in North and South Dakota and abortion rights have always won.
The thing is, anti-abortion has been successful playing offense. It's whining about "babies" and posting pictures of babies when talking about something else entirely, fetuses, has won over many legislators and some of the public. Now anti-abortion has to play defense and it seems to be a deer in the headlights.
Abortion rights is now talking about women's rights. From the old white men there is silence.
a milestone around one's neck or a millstone around one's neck ... is this your speech recognition software at work or was the Econ department too far from the English department at Minard?
ReplyDeleteGovernor Doug Burgum signed the 6-week abortion ban in a State where there are no abortion centers, no killing centers, no extermination centers of unborn babies.
Except for a few counties around Hennepin in Minnesota, the rest of Minnesota probably prefers being part of North Dakota. The crazy, insane politics of the Twin Cities is antithetical to rural and small town Minnesota. I imagine something similar could be said about Iowa and Wisconsin.
As of now, North Dakota legislators just passed an abortion ban in a State without a killing center.
Meanwhile, the nuts in blue cities are falling all over themselves to decriminalize abortion up until birth, lest no one be confused by the extreme nature of their hollow moral senses and affiliation with the youngest human beings. Which dumbbell State will be the first to lay down a law allowing transgender women (men in dresses) the right to abort. This will be virtue-signaling of the highest order.
I don't think anyone really knows how the post-Roe State-by-State legal landscape will unfold. We are seeing how limitless the left are in their thirst for blood.
Remember when the left's battle cry was safe, legal and rare? One would be booted out of a Democrat precinct meeting with that sort of motto now.
Matt "I don't think anyone really knows how post-Roe State-by-State landscape will unfold."
DeleteI agree we can never for the future for certain. There is one thing that IS certain. Anti-abortion strategists are trying to avoid state-wide votes on abortions. They think they know where they stand with voters.
The one thing you think is certain is not certain.
DeleteNorth Dakota make the Republican super-ridiculous majority even larger at the last election, knowing that that those folks were not pro-abortion Democrats.
Even those that think Governor Burgum is a social liberal had to see that he signed the 6-week abortion ban.
Young people, women and many former Democrats see that abortion kills a human being. They aren't buying the 'abortion is healthcare' garbage.
Minnesota would be a surprising pro-life vote if their legislature would allow it put to a vote. I foresee a slow diminishment of the DFL as the rural areas become more Republican. Biden could care less about the northern Minnesota fossil fuel sector or the entire agricultural sector. The DFL should just drop the FL part of their name as they care less about the farmer or laborer.
Biden's going to run again. Who is going to challenge him for the Presidency? AOC? Ilhan Omar? Bernie Sanders? Chris Cuomo? Gavin Newsom? Beto?
Who makes money from a statewide prohibition on abortion that forces birth on it’s pregnant female citizens under penalty of law? Who ends up footing the bill?
ReplyDeleteThe dog has a new bone to chew on. It's called "forced birth". It has no legs since it has no body to it.
DeleteWe also have laws on forced speed limits, forced honesty, forced feeding, and any number of forced behavior.
Think of it another way and the language dynamic changes. Instead of forced birth, we have forced respect for life. We have mandatory school attendance. We are forced to obey laws or face the consequences.
Forced birth is nothing more than the simple concept that if you become pregnant, you are responsible for the welfare of another human being. You can't pawn that responsibility off on your neighbor unless he is willing to accept that responsibility. It's called adoption. The child is born and you are forced to take care of it or risk jail if you don't give the baby up for adoption.
As a society we have been hoodwinked by Democrats who think it is virtuous to have children out of wedlock. We pay women to have fatherless children. If they have enough children, they can make a living off of government support. I think the term "welfare queen" was coined to describe this.
What if we didn't pay women who had children out of wedlock? Might it not encourage more adoption? Or other responsible behavior? What if every child born had to have a father's name on the birth certificate?
We would have to close the abortion loophole. You can't kill your dependent to get out of your responsibility.
What if we outlawed pre-marital sex? And did away with no-fault divorce? The old system of marriage would be a welcome change.
Let's make schools center of education. No longer would schools have any authority over a child's life outside of education. No more steering kids towards abortion behind their parents' backs. No more steering kids towards transgenderism or homosexuality behind their parents' backs.
It's time for public schools to be reformed. Big Education has to go.
Matt, as usual the force of your intellect is stunning.
DeleteThe US is always in a state of ugly intolerance, much of it due to “alliances between church and throne.” It is puzzling why some people eager to “re-orient the tide of culture toward virtue, character, and responsibility” would look to Christianity and its unholy union with a state to reset the moral compass. That formula brought us here in under 250 years.
